Please read these Terms and Conditions carefully - by using the services of Dennis & Son Flooring Ltd you are entering into a contract with us and agreeing to the following Terms and Conditions.
“We”, “Us” and “Our” means Dennis & Son Flooring Ltd. “You”, “The Client”, “The Customer”, “Your” means the person who requested our services and enters into this contract.
1. Scope of Work
1.1 Quotations: Quotations are valid for 28 days. Please note material prices are subject to increase between the date of the quote and date of order for reasons out of our control, should this happen we will inform the customer as soon as we are aware of these changes.
1.2 Agreement: The scope of work for our services shall be agreed upon between Dennis & Son Flooring Ltd and the client by way of an agreed final quote. This agreement shall include details such as the type of flooring, materials, labour and any specific requirements.
The acceptance of the quote, electronically or by any other means signifies a full acceptance and commitment to accept these terms and conditions.
Please note, Despite a wealth of knowledge we cannot guarantee that our initial assessment is correct when sub-floor coverings are still in place. Therefore, we cannot be held accountable for amendments to costs or materials required to carry out the job to the standard required. We will discuss any changes with you as soon as possible.
1.3 Changes to project: Any quote or estimate is subject to revision, if a customer wishes to make changes after receiving a quote from Dennis & Son Flooring Ltd, the customer must let us know as soon as possible, so their quote can be revised. Any changes made without notifying us, may cause a delay in the work until a price has been agreed for these changes. (Also see section 1.2 Agreement and 2.1 Pricing for changes that may be applied by Dennis & Son Flooring Ltd).
1.4 Completion timescales: Estimated completion times are guidelines and although we will endeavour to complete the work in the time frame intimated, we will not be held liable for failure to complete the scheduled works within the estimated time frame.
2. Pricing and Payment
2.1 Pricing: The pricing for our services shall be determined based on the agreed-upon quotation. Additional costs may be incurred for any changes or additional services requested by the Client or if we need to apply additional costs due to unforeseen issues/ detect further work that may be required, any additional costs will be discussed with the client as soon as possible. The client then has the option to continue with the contract or cancel it by agreement and settle any outstanding amounts.
2.2 Payment Terms: Payment for our services shall be made according to the payment terms agreed upon between Dennis & Son Flooring Ltd and the Client. Full payment of
materials is required as a deposit prior to the commencement of work, with the final balance due within 7 days of completion.
2.3 Late Payment: In the event of late payment, Dennis & Son Flooring Ltd may charge interest or late fees as permitted by applicable law.
3. Responsibilities
3.1 Client's Responsibilities: The Client shall provide clear access to the work area and ensure that it is free from any obstructions. The Client is responsible for the removal of any furniture, fixtures, or other items that may hinder the floor laying process. Although we will be pleased to help with the moving of heavy objects, this must be a prior arrangement and a further charge will apply. Dennis & Son Flooring Ltd accepts no responsibility for damage to property not moved or whilst being moved.
The client will also be expected to provide electrical power, running water and toilet facilities where reasonably possible.
During the winter months, it is essential that your heating system is operative before any flooring installation. Failure to ensure this may cause irreparable damage to the floor covering of which Dennis & Son Flooring Ltd cannot accept any responsibility.
3.2 Flooring Materials: If the Client provides the flooring materials, Dennis & Son Flooring Ltd shall not be liable for any defects or issues related to the quality, suitability, or installation of those materials.
Any materials supplied by Dennis & Son Flooring Ltd will alway be of high quality and used in an appropriate manner as per the manufacturer's guidelines.
4. Workmanship and Warranty
4.1 Workmanship: Dennis & Son Flooring Ltd shall perform the flooring services with
reasonable skill, care, and professionalism in accordance with industry standards.
4.2 Warranty: Dennis & Son Flooring Ltd provides a warranty on its services for one year from the date of completion, this warranty covers any defects in workmanship. Any materials supplied by us carry a guarantee provided by the manufacturer.
4.3 Limitations: The warranty/guarantee does not cover damage or defects caused by improper use, maintenance, or negligence by the Client or any third party. It also does not cover normal wear and tear or natural variations in the appearance of natural materials.
5. Liability and Insurance
5.1 Limitation of Liability: Dennis & Son Flooring Ltd shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the flooring services provided.
5.2 Insurance: Dennis & Son Flooring Ltd maintains appropriate insurance coverage, including liability insurance, to protect against any potential damages or claims arising from our service.
6. Termination
Either party may terminate the agreement in the event of a material breach by the other party. Termination shall be communicated in writing, specifying the reasons for termination.
Dennis & Son Flooring Ltd will not tolerate aggressive or rude behaviour, racism, nationalism, sexism, homophobia or ageism directed towards any of its staff or tradesperson and reserves the right to terminate the project at any time in this event.
7. Cancellation, Returns & Refunds
7.1 Cancellations: In the event of cancellation by the client, the client agrees to notify Dennis & Son Flooring Ltd 7 days before the project start date. In the event that we are not notified of the cancellation, the client agrees to pay all of Dennis & Son Flooring Ltd administration, lost work and scheduling costs amounting to no less than 20% of the total labour charge.
7.2 Returns & Refunds: Orders for materials can only be cancelled without penalty prior to the despatch of goods from our suppliers. Thereafter, all cancellations and returns will be subject to a restocking fee of 30%, plus return carriage charge. A refund of goods cost will be made within 30 days of receiving your notice of cancellation, the delivery and return charges will not be refunded. This does not affect your consumer statutory rights.
7.3 Made to measure/bespoke materials: No returns or refunds can be made for orders where materials such as carpets have been cut or or when products have been made to order and/or are bespoke. We can also not offer returns/refunds on any products that have been discontinued or are no longer available.
8. General
8.1 Doors & Plinths: If the floor height changes and there is not enough clearance for doors and plinths, we can offer a trimming service for an additional cost. This is usually identified at quotations.
8.2 Waste & Off-Cuts: All trimmings, offcuts and wastage is the customer's own property. Dennis & Son Flooring Ltd cannot dispose of this for you unless you have made arrangements with ourselves to do this on your behalf. The local authority considers this as trade waste, but it can be disposed of by yourself free of charge at your local tip.
8.3 Flattening of pile: Carpet is a soft, luxurious product and flattening of the pile will occur as a natural result of use. The sides of the pile appear a slightly different shade in colour to the ends. Therefore, any flattening will change the apparent colour of the carpet. Such shading and flattening is not a fault. Areas with busy foot traffic, twists and turns (near stairs and in front of seating) can be especially prone to such changes in appearance.
8.4 Underlay: All carpets benefit from the installation of a good quality underlay. Re-using existing underlay may result in abnormal flattening of the pile and invalidate manufacturers wear warranties.
8.5 Damage to client decor: Dennis & Son Flooring Ltd carry out work with reasonable care and skill but even with the greatest care home décor may be marked or scuffed during the fitting process. New paintwork and wallpaper should be allowed to fully dry and harden before fitting, a minimum of two weeks is recommended. Dennis & Son Flooring Ltd will not accept any liability for costs associated with redecoration for damages caused.
8.6 Removal of skirting boards: The installation of Luxury Vinyl Tiles, Laminate or Engineered Wood may involve the removal and re-pinning of skirting boards and/or architraves. Dennis & Son Flooring Ltd will not accept any liability for costs associated with redecoration of these.
